Mindful12 Privacy Policy

Mindful12 respects your privacy and is committed to protecting your personal information. This Privacy Policy explains what information we collect, how we use and protect it, when limited disclosure may be necessary, and the choices available to you.

This Policy applies to the Mindful12 mobile application, web application, website, community features, and related services (collectively, the “Program”).

1. Information We Collect

The information we collect depends on how you access and use Mindful12.

Information You Provide

We may collect information that you provide directly, including:

  • Your name and email address.
  • Your username, password, and other account credentials.
  • Profile information you choose to provide.
  • Employer or sponsoring-organization information associated with a workplace account.
  • Community posts, comments, messages, and other content you choose to submit.
  • Reflections, ratings, survey responses, and feedback.
  • Communications you send to Mindful12, including support requests.
  • Subscription and transaction information.
Passwords are protected using appropriate security measures. Mindful12 does not store passwords in readable form.

Payments may be processed by an application store, payment processor, employer payroll system, or another authorized provider. Mindful12 does not ordinarily receive or store your complete credit-card number.

Information Collected Automatically

When you access or use the Program, certain technical and usage information may be collected automatically, including:
  • Device type, model, operating system, and application version.
  • Browser type and language settings.
  • Internet Protocol address.
  • Login times, access dates, and system logs.
  • Pages, challenges, lessons, and features accessed.
  • General interaction and performance information.
  • Error reports, diagnostic information, and security events.
  • Cookie identifiers and similar technologies used on the website or web application.
Mindful12 may measure participation, such as whether a challenge or Program feature was accessed. We do not use this information to diagnose medical or mental-health conditions.

Information Received From an Employer or Sponsoring Organization

If your access is provided through an employer or another organization, that organization may provide limited information needed to establish or administer your eligibility, such as:
  • Your name.
  • Your work email address.
  • Your employee group or organizational affiliation.
  • Information confirming your eligibility to participate.
Your employer does not provide Mindful12 with access to your private medical records through the Program.

2. How We Use Information

Mindful12 uses personal information only for legitimate Program and operational purposes, including to:

  • Create, authenticate, and maintain your account.
  • Provide access to Mindful12 content and features.
  • Deliver challenges, communications, reminders, and Program materials.
  • Administer memberships, subscriptions, and authorized payments.
  • Provide technical and participant support.
  • Maintain the safety, security, and reliability of the Program.
  • Detect and prevent fraud, unauthorized access, abuse, and security threats.
  • Moderate community content and enforce Program policies.
  • Understand general participation and usage trends.
  • Evaluate and improve Program content, design, and performance.
  • Communicate service, account, privacy, and policy updates.
  • Comply with applicable laws and valid legal obligations.
  • Protect the rights, safety, and security of Mindful12 and its participants.
Mindful12 does not use personal information for unrelated third-party advertising.

3. Information We Do Not Sell or Use for Advertising

Mindful12 does not:

  • Sell personal information.
  • Rent or trade personal information.
  • Share personal information for cross-context behavioral advertising.
  • Allow advertisers to use Mindful12 information to target participants.
  • Provide employers with private reflections or individual content-usage histories.
  • Use community posts to create advertising profiles.
  • Use participant information to determine employment eligibility, compensation, promotion, discipline, or other employment decisions.
Mindful12 does not receive payment in exchange for providing personal information to third parties.

4. Information Provided to Employers

Protecting the privacy of workplace participants is a fundamental part of Mindful12.

An employer or sponsoring organization may receive aggregated or de-identified information about overall Program participation, such as:

  • The number or percentage of eligible participants who registered.
  • The number or percentage of participants who accessed a challenge or Program feature.
  • General participation trends across a sufficiently sized group.
  • Overall, combined ratings or feedback that do not identify individual participants.
Mindful12 does not provide an employer with:
  • Your private reflections.
  • Your password.
  • Your private support communications.
  • Your individual challenge responses.
  • A detailed history of your personal activity.
  • Information intended to reveal a medical or mental-health condition.
  • The identity of the author of anonymous feedback.
If you post content in a workplace community, that content will be visible to the authorized members who have access to that community. A participant should not treat community posts as private communications.

Limited account-administration information, such as enrollment or account status, may be available to an authorized administrator when reasonably necessary to manage eligibility, membership, or payroll authorization. It will not include private reflections or detailed personal activity.

Mindful12 will not provide individual-level information to an employer for another purpose unless you specifically authorize it or disclosure is required by law.

5. When Information May Be Disclosed

Mindful12 does not disclose personal information except in the limited circumstances described below.

Service Providers

Mindful12 may use carefully selected service providers to operate and support the Program. These may include providers of:

  • Secure technology infrastructure.
  • Application hosting and account management.
  • Email and Program communications.
  • Payment and subscription processing.
  • Data security, maintenance, and technical support.
  • Analytics used to understand and improve Program performance.
These providers may process information only as necessary to perform services for Mindful12. They are not authorized to sell the information or use it for their own advertising purposes.

Legal and Safety Requirements

Mindful12 may disclose information when it reasonably believes disclosure is necessary to:
  • Comply with a law, regulation, subpoena, court order, or other valid legal process.
  • Investigate or prevent fraud, misuse, security threats, or unlawful activity.
  • Protect the rights, property, or safety of Mindful12, its participants, or others.
  • Establish, exercise, or defend legal rights.
When legally permitted, Mindful12 will seek to limit any disclosure to the information reasonably required.

Business Changes

If Mindful12 is involved in a merger, acquisition, financing, reorganization, or transfer of business assets, information may be reviewed or transferred as part of that transaction. Any successor will be required to handle personal information consistently with this Policy and applicable law.

Mindful12 will not treat a business transaction as permission to sell participant information for advertising.

At Your Direction

Mindful12 may disclose information when you expressly request or authorize the disclosure, such as when you choose to connect Mindful12 with another service.

6. Community Content and Sensitive Information

Mindful12 communities are intended to provide a supportive environment, but community posts are visible to other authorized members of that community.

Please do not post:

  • Medical records or diagnostic information.
  • Highly sensitive health or mental-health information.
  • Confidential workplace or business information.
  • Financial-account information.
  • Government identification numbers.
  • Another person’s private information.
  • Anything you do not want other community members to see.
Mindful12 may review, restrict, or remove community content when reasonably necessary to enforce its Community Standards, protect participants, respond to reports, or comply with legal obligations.

Mindful12 does not analyze community posts for the purpose of diagnosing medical or mental-health conditions. Community content is not treated as a confidential communication with a healthcare provider.

If you delete a community post, copies may remain temporarily in system backups or where retention is required for security, legal, or dispute-resolution purposes.

7. Cookies and Similar Technologies

The Mindful12 website and web application may use cookies, local storage, software development kits, or similar technologies to:

  • Keep you signed in.
  • Remember account and accessibility preferences.
  • Maintain security.
  • Understand whether the Program is operating correctly.
  • Measure general use of Program features.
  • Diagnose technical problems.
Mindful12 does not use these technologies to sell personal information or deliver third-party behavioral advertising.

You may be able to manage cookies through your browser or device settings. Disabling necessary technologies may prevent certain Program features from operating correctly.

8. Communications

Mindful12 may send service-related communications concerning:

  • Account creation and security.
  • Password resets.
  • Program schedules and challenges.
  • Subscription or billing changes.
  • Privacy or policy updates.
  • Important technical or safety information.
Because these communications are necessary to administer the Program, you may not be able to opt out of all service-related messages while maintaining an active account.

You may opt out of nonessential promotional emails by using the unsubscribe link in the email or contacting Mindful12. Opting out of promotional communications does not cancel your membership.

9. Data Security

Mindful12 uses reasonable administrative, technical, and organizational safeguards designed to protect personal information. These safeguards may include:

  • Encryption during transmission.
  • Secure hosting and technology providers.
  • Role-based access controls.
  • Password and authentication protections.
  • System monitoring and logging.
  • Restricted internal access.
  • Vendor-security requirements.
  • Procedures for responding to suspected security incidents.
Access to personal information is limited to authorized individuals and service providers who reasonably require it to operate, secure, or support the Program.

No website, application, transmission method, or electronic-storage system can be guaranteed to be completely secure. Participants are also responsible for protecting their passwords, devices, and account credentials.

If Mindful12 discovers a data-security incident involving personal information, it will investigate and provide any notices required by applicable law.

10. Data Retention

Mindful12 retains personal information only for as long as reasonably necessary to:

  • Maintain and provide the Program.
  • Fulfill the purposes described in this Policy.
  • Complete authorized transactions.
  • Maintain security and prevent fraud.
  • Resolve disputes.
  • Enforce agreements.
  • Comply with legal, accounting, and reporting obligations.
Retention periods may vary depending on the type of information and the reason it was collected.

When information is no longer reasonably required, Mindful12 will delete, anonymize, or securely isolate it, subject to applicable legal requirements and routine backup procedures.

Aggregated or de-identified information that can no longer reasonably identify an individual may be retained for Program analysis and improvement.

11. Your Privacy Rights and Choices

Depending on where you live, you may have the right to:

  • Request access to personal information Mindful12 maintains about you.
  • Request correction of inaccurate personal information.
  • Request deletion of your account and personal information.
  • Obtain a portable copy of certain information.
  • Request restriction of or object to certain processing.
  • Withdraw consent where processing is based on consent.
  • Opt out of certain communications.
  • Appeal the denial of a privacy request where applicable.
  • Receive equal service without unlawful discrimination for exercising a privacy right.
You may update certain account information through your profile or account settings.

To submit a privacy request, contact [email protected]. Mindful12 may need to verify your identity before completing the request. Verification information will be used only to process and protect the request.

An authorized agent may submit a request where permitted by law. Mindful12 may require evidence of the agent’s authority and may ask the participant to verify the request directly.

Certain information may be retained when reasonably necessary to comply with law, prevent fraud, maintain security, complete transactions, or establish or defend legal claims.

Mindful12 does not discriminate against participants for exercising applicable privacy rights.

12. Account Deletion and Subscription Cancellation

You may request deletion of your Mindful12 account by using the account-deletion option provided in the Program or by contacting [email protected].

Deleting the Mindful12 application from your device does not:

  • Delete your account.
  • Delete information associated with your account.
  • Cancel an individual subscription.
  • Cancel an authorized payroll deduction.
Subscriptions purchased through the Apple App Store, Google Play, or another platform may need to be canceled through that platform. Employer-sponsored payroll deductions may need to be canceled through the designated Mindful12 or employer procedure.

An account-deletion request and a subscription-cancellation request are separate actions unless Mindful12 expressly confirms otherwise.

13. Children’s Privacy

Mindful12 is intended for adults who are at least 18 years old. It is not directed to children under 13, and Mindful12 does not knowingly collect personal information from children under 13.

If Mindful12 learns that personal information was collected from a child under 13, it will take reasonable steps to delete the information.

A parent or guardian who believes a child has provided personal information to Mindful12 should contact [email protected].

14. Application Permissions

The Mindful12 mobile application may request limited device permissions when necessary for a feature you choose to use, such as notifications.

You may manage application permissions through your device settings. Disabling a permission may limit the related feature but will not authorize Mindful12 to access other information on your device.

Mindful12 does not access contacts, photographs, precise location, microphone recordings, or other device information unless a specific feature requires it and you grant permission.

15. Links and Third-Party Services

Mindful12 may contain links to websites, application stores, or services operated by others. Their privacy practices are governed by their own policies, not this Privacy Policy.

Mindful12 encourages participants to review the privacy policy of any third-party service before providing personal information.

16. Changes to This Privacy Policy

Mindful12 may update this Privacy Policy to reflect changes in the Program, technology, business practices, or legal requirements.

The revised Policy will display a new “Last Updated” date. If a change materially affects how personal information is collected, used, or disclosed, Mindful12 will provide reasonable notice through the Program, by email, or through another appropriate method.
